Online Sales, Shipping and Returns

1. About Live Africa
This website is operated by Robfair Investments No. 10 (Pty) Ltd, trading as Live Africa (“Live Africa”, “we”, “us” or “our”).

Our contact details are:
Live Africa
G10 Sunrise Park
Sunrise Circle
Ndabeni, Cape Town
7405, South Africa
Email: info@liveafrica.co.za
Telephone: +27 (0)21 204 6040

2. Application of These Terms
These Terms & Conditions apply to purchases made directly from Live Africa through:

  • www.liveafrica.co.za;

  • Our Cape Town showroom;

  • Telephone or email orders; and

  • Any other sales channel operated directly by Live Africa.

Purchases from an independent retailer are also subject to that retailer’s terms and return procedures. Customers should generally contact the original retailer first regarding returns or warranty claims.

Separate trading terms may apply to authorised dealers, resellers, commercial customers and account customers.

By placing an order with Live Africa, you confirm that you have read and accepted these Terms & Conditions.

Nothing in these terms is intended to limit any rights granted to a consumer under applicable South African law.

3. Products and Product Information
We make reasonable efforts to ensure that product descriptions, specifications, photographs, colours and prices are accurate.

Product colours and appearance may vary slightly because of lighting, photography, production changes or screen settings.

Manufacturers may change product specifications, designs, colours, packaging or included accessories without notice. Where a material change affects an existing order, we will notify the customer where reasonably possible.

Images are for illustrative purposes. Unless expressly stated, accessories or other products shown in lifestyle photographs are not included.

4. Pricing
All retail prices displayed on the website are in South African rand and include VAT unless stated otherwise.

Dealer, reseller, commercial and export prices may be quoted excluding VAT.

Prices, promotions and product availability may change without notice. A price change will not affect an order that has already been accepted and paid for, except where an obvious pricing error has occurred.

If a product is displayed at an obviously incorrect price because of a technical or administrative error, we may cancel the order and refund the amount paid.

Errors and omissions excepted.

5. Orders and Order Acceptance
Submitting an order does not automatically mean that the order has been accepted.

An order is accepted once:

  • Payment has been successfully received or approved;

  • The product is confirmed as available; and

  • Live Africa issues an order confirmation or begins processing the order.

We may decline or cancel an order if:

  • The product is unavailable;

  • Payment cannot be verified;

  • Fraud or unauthorised activity is suspected;

  • Delivery cannot reasonably be completed;

  • The order contains an obvious pricing or product-information error; or

  • The order breaches these Terms & Conditions.

If we cancel an order after payment has been received, we will refund the amount paid using the original payment method where reasonably possible.

6. Payment
Payment must be made using one of the payment methods offered by Live Africa.

Orders will generally only be dispatched once full payment has cleared, unless the customer has an approved trading account or another written arrangement with Live Africa.

Customers are responsible for ensuring that payment details and billing information are correct.
Any instalment, credit or buy-now-pay-later facility offered by a third-party provider is also subject to that provider’s separate terms and approval requirements.

7. Product Availability
All products are subject to availability.

Adding a product to a shopping cart does not reserve it. If a product becomes unavailable after an order is placed, we will contact the customer and offer:

  • A suitable alternative;

  • A back order, where available; or

  • A refund.

8. Delivery Within South Africa
Live Africa delivers to physical addresses within South Africa. We cannot deliver to a post-office box.
Delivery charges and any free-delivery qualification will be displayed at checkout or confirmed in the quotation.

Delivery estimates are calculated in business days and are not guaranteed. Most deliveries take approximately one to five business days, depending on the destination, product size and courier service.

Orders placed after 12:00 may only be processed on the following business day.

Deliveries do not ordinarily take place on weekends or public holidays. Delivery delays may occur during peak periods, including December and January.

Live Africa is not responsible for delays caused by events outside its reasonable control, including courier delays, severe weather, strikes, road closures, load shedding or incorrect delivery information.

9. Delivery Details and Access
The customer must provide an accurate:

  • Street address;

  • Contact person;

  • Telephone number; and

  • Any delivery or access instructions.

Additional delivery charges caused by incorrect or incomplete information, an unavailable recipient or restricted access may be charged to the customer.

The customer must ensure that the delivery location is reasonably accessible and suitable for the size and weight of the product.

10. Receiving and Inspecting Deliveries
The customer or authorised recipient should inspect the outer packaging when the product is delivered.

Any visible transport damage, missing parcels or incorrect products should be reported to Live Africa as soon as reasonably possible. Photographs of the packaging, shipping label and product may be required.

Reporting transport damage promptly assists Live Africa in submitting a claim to the courier. A delay in reporting does not remove any statutory rights the customer may have.

Customers should retain the original packaging until they have inspected and tested the product.

11. International and Cross-Border Orders
International or cross-border orders are subject to approval and may require a separate delivery quotation.

Unless agreed otherwise in writing, the customer is responsible for:

  • International transport charges;

  • Customs duties;

  • Import or export charges;

  • Local taxes;

  • Clearance fees;

  • Insurance; and

  • Compliance with the laws and product requirements of the destination country.

Delivery estimates for international orders are not guaranteed.

Warranty support for products purchased or used outside South Africa is governed by the Live Africa Warranty Policy. Physical warranty inspections, repairs and replacements are handled within South Africa.

12. Change-of-Mind Returns
In addition to any rights provided by law, Live Africa offers a 30-day change-of-mind return period for qualifying products purchased directly from Live Africa.

To qualify, the product must:

  • Be returned within 30 calendar days after delivery;

  • Be unused and undamaged;

  • Include all original components, manuals, accessories and labels; and

  • Be returned in its original packaging.

The customer must contact Live Africa before returning the product. Unauthorised returns may be refused or delayed.

The customer is responsible for the cost and risk of returning a non-defective change-of-mind product.
A change-of-mind return may be refused where the product:

  • Has been used;

  • Has been damaged after delivery;

  • Is incomplete;

  • Has been altered or modified;

  • Cannot be resold for hygiene or safety reasons;

  • Was specially ordered, customised or personalised for the customer; or

  • Is otherwise excluded from voluntary returns or returnable rights under applicable law.

This voluntary 30-day policy does not limit any cooling-off or return rights available under South African law.

13. MSpa, VTUVIA and QIOLOR Change-of-Mind Returns
MSpa, VTUVIA and QIOLOR products must be returned with all original components, accessories, manuals and packaging.

Where a non-defective product has been unpacked, assembled or handled beyond what is reasonably necessary to inspect it, Live Africa may deduct a reasonable amount for:

  • Inspection;

  • Disassembly;

  • Repacking;

  • Missing or damaged packaging;

  • Use or diminished value; and

  • Work required to restore the product to a saleable condition.

For these products, the reasonable deduction may be up to 10% of the original purchase price, depending on the condition of the returned product.

No restocking deduction will be applied merely because a product is defective, unsafe or otherwise returnable without penalty under applicable consumer law.

14. Order Cancellations
Customers should contact Live Africa as soon as possible if they wish to cancel an order.

If the order has not yet been processed or dispatched, we will endeavour to cancel it and issue a refund.
If the order has already been dispatched, it may need to be handled as a return. The customer may be responsible for reasonable transport or return costs where permitted by law.

Special-order, customised or imported-on-request products may be subject to reasonable cancellation charges where permitted by law.

15. Defective, Unsafe or Incorrect Products
If a product is defective, unsafe, materially different from its description or otherwise fails to meet applicable legal quality standards, the customer must contact Live Africa as soon as reasonably possible.
Live Africa will handle the matter in accordance with applicable South African consumer law and the Live Africa Warranty Policy.

Customers may be required to provide:

  • Proof of purchase;

  • Product model and serial number;

  • A description of the problem; and

  • Photographs or videos demonstrating the fault.

Depending on the product and fault, Live Africa may arrange an inspection, collection, repair, replacement or refund.

Nothing in these terms limits a consumer’s statutory rights concerning defective or unsafe goods.

16. Warranty
Aqua Marina, MSpa, VTUVIA and QIOLOR products are covered by the applicable product and component warranties.

Warranty periods, claim procedures, cross-border arrangements and exclusions are explained in the separate Live Africa Warranty Policy.

The Warranty Policy forms part of these Terms & Conditions and should be read before using the product.
Warranty claims may be submitted to info@liveafrica.co.za.

17. Return Procedure
Before returning any product, contact Live Africa at info@liveafrica.co.za.

Please provide:

  • Your name and contact details;

  • Order or invoice number;

  • Product description;

  • Reason for the return; and

  • Photographs or videos where relevant.

Live Africa will confirm the return address, collection arrangements and any packaging requirements.
Products must be securely packaged. Where the original packaging is no longer available, the customer must use suitable protective packaging.

Responsibility for return transport costs and risk depends on the reason for the return and the customer’s applicable statutory rights.

18. Refunds
Approved refunds will ordinarily be processed using the original payment method.
Refunds are generally processed within seven to ten business days after the returned product has been received and inspected. Banking institutions and payment providers may require additional time to reflect the refund.

Where applicable and permitted by law, reasonable collection, usage, repacking, restoration or return-delivery charges may be deducted from the refund.
Delivery fees may not be refundable where the original delivery service was completed correctly and the return is solely because the customer changed their mind, subject to applicable law.

19. Promotions and Discount Codes
Promotions and discount codes:

  • Apply only during the advertised period;

  • Are subject to availability;

  • Cannot be exchanged for cash;

  • May not be combined unless expressly stated; and

  • May be subject to additional promotion-specific terms.

Live Africa may correct, suspend or withdraw a promotion affected by fraud, misuse, technical errors or obvious pricing mistakes.

20. Product Use and Safety
Customers must read and follow all instructions, warnings, assembly guides and maintenance requirements supplied with a product.

Products must only be used for their intended purpose and within the published weight, pressure, electrical, environmental and operating limits.

Electric bicycles, watercraft and spas carry inherent risks. Customers are responsible for using appropriate safety equipment and complying with applicable laws and local regulations.

21. Website Use
The content of this website is provided for general information and product sales.

Users may not:

  • Interfere with the operation or security of the website;

We may restrict access to the website where misuse or unlawful activity is suspected.

22. Intellectual Property
The website content, including text, photographs, graphics, logos, videos, product layouts and design elements, belongs to Live Africa, its suppliers or its brand partners and is protected by applicable intellectual-property laws.

Content may not be reproduced, distributed or used commercially without prior written permission.

23. Third-Party Services and Links
The website may contain links to third-party websites or use third-party payment, delivery, review or marketing services.

Live Africa is not responsible for the content, availability or independent practices of third-party websites and service providers.

Use of a third-party service may be subject to that provider’s own terms and privacy policy.

24. Limitation of Liability
To the extent permitted by law, Live Africa will not be liable for indirect, incidental or consequential losses arising from:

  • Misuse of a product;

  • Failure to follow safety or operating instructions;

  • Unauthorised modifications or repairs;

  • Use of incompatible components or accessories;

  • Events outside Live Africa’s reasonable control; or

  • The customer’s breach of these terms.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability arising from gross negligence or any rights that cannot be waived under applicable consumer law.

25. Privacy and Cookies
Personal information is processed in accordance with the Live Africa Privacy Policy.

Information about cookies, analytics and similar website technologies appears in the separate Cookie Policy.

By using the website, customers acknowledge that they have had an opportunity to review these policies.

26. Changes to These Terms
Live Africa may update these Terms & Conditions when its services, procedures or legal obligations change.

The version applying to an order is generally the version published when the order was placed.

The date of the latest update should be displayed at the top or bottom of this page.

27. Severability
If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

28. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.

Nothing in this section prevents a consumer from exercising any right to approach an appropriate consumer commission, ombud, tribunal or court.
